I purchased a condo,signed S&P back in 2011,not realising the seller has fraud payment with his loan bank. After all the hassle for 3 years, finally my loan was released to the seller's bank to clear. The problem now is, the S&P selling price was RM155k, but my loan released to the seller's bank was RM160k. i have even paid him RM15.5k as deposit when we signed S&P as well as paid about RM12k for his maintenance fee and assessment fee that he have not been paying for years, as my lawyer said will deduct when loan is released. in such situation, can i sue the seller if he is not willing to refund me the difference? please advise.
