The obligation of the seller and the purchaser is stipulated in the Sale and Purchase Agreement (“SPA”) executed between the parties.

Generally, there will be a clause in the SPA that requires the seller to deliver vacant possession to you within a stipulated time frame i.e. delivering the key to the property to you.

If the seller fails to deliver vacant possession to you despite being paid the full purchase price then you can claim liquidated ascertained damages from the seller. LAD is a clause which will be in your SPA. Hence, it is best to take a look at your SPA to protect your rights.
