1. On 27/04/2016, I paid down payment, 10%, (RM40k) of the condominium price, RM400k. After paying the cheque, the clerks gave me the SPA to sign on the spot. I thought 27/04/2016 was the date of SPA.
2. I paid the down payment 10% full because the offer letter sent by the developer stipulates that I must the amount in order to sign the SPA within 26/04/2016 till 11/05/2016.
2. I hired the lawyer provided by the developer to make the SPA. The lawyer put the date of SPA on 22/09/2016. I don't remember if it was September or October of 2016, the lawyer called me to go to the lawyer's firm to complete the signings of the SPA. I didn't know the date of SPA was put 22/09/2016 instead, not the same date as the day (24/04/2016) when I paid full down payment 10% of the condo price.
3. Today is 20/09/2020, the developer still hasn't handed me the house key.
4. According to the SPA, I am entitled to get LAD due to the late delivery of the house.
5. My question is, I don't know which date should be started to count for the LAD? From 24/04/2019 (36 months after paying full down payment 10%) or from 22/09/2019 (36 months of the SPA date)?

Legal sifus, please help me.
