Can a developer under a Supplementary Agreement, accessories the car park bay that is part of the purchase package and in the SPA and DMC originally entered into by both parties.
Can the developer then charge a maintenance fee for the accessories car park bay which in the Original SPA is already part of the yearly maintenance fees.
As an inducement to sign the Supplementary Agreement by the Purchaser, the Developer states that the car park bay will then be owned by the Purchaser. If not, the purchaser does not own the car park bays but it will be Common property? Please advise.
