Hi. I am a tenants that signed a 1 year rental agreement. I paid a deposit of one month rental deposit to secure the rental place, but after they hand over the keys, I was tied up with work and forgot to make the balance payment on time .
after 1 week plus I sent the balance payment which includes deposit and misc fees and commission. and the agent replied they are terminating the agreement and padlocked the place because I can't be reached to chase for payment. I wasn't using the place yet.
note I am a foreigner and renting the house for holiday stays and I wasn't in malaysia for 1-2weeks. the malaysia phone I have was not the main phone and I don't have the habit of carrying it around or check messages regularly.
I understand I am at fault here for the late payment.
my questions are:
1. the first deposit of 2000 most likely will be forfeited. the second payment 8000 was sent to agent company account. can it be refunded?
2 they didn't sent any messages of termination to me while I saw missed calls, the agent never WhatsApp any termination message. so I was still thinking to pay the balance to complete the process. but after I transfer 8000 agent say owner wants to terminate.
is this considered ethical to with hold the termination message ?
3. in this case who do I seek help from? police ? miea ? I feel unjust because they should message me a termination message and not let me pay and then inform. now it's hanging and I am chasing the second 8000 payment refund. I am willing to forfeit the first 2000.
