Hi, I have signed an option to purchase and paid 2% earnest through agent. To date, when I asked for a copy of title etc it has been avoided. In fact I have not even got the signed copy (by seller) of the option to purchase. In the meantime the agent seems to be pushing to sign the SPA. I asked for title copy etc for loan submission and did not get it. So I got another lawyer to do a land search for me - and I found a private caveat has been lodged by some other purchasers. My questions: 1. Is it legal to try and sell when there is an existing private caveat? 2. Should I sign the SPA without this caveat being cleared off. 3. Is it possible for me to demand my 2% back? 4. Is there any other items I should consider? Please advise. Thanks.
