How do I proceed? I have to terminate my tenancy agreement, due to personal reasons I need to leave Malaysia. I have lived in the property for 2 months. In the contract it states there is "no termination in the tenancy agreement" and "In the event the tenanct shall unlawfully terminate this agreement before the expiry date, that party shall serve on other party hereto a notice to quite of the at least 2 months' notice and provide always a sum equivalent to the remaining period of 12 months tenancy shall be compensated by whichever party who committed the break of the aggravated party". So My understanding is that I will have to pay a further 10 months on a lawful agreement. However, our tenance agreement has not yet been stamped at the LHDN (I'm assuming that is what is meant by the stamping office that our agent informed me of) and will not be completed until Wednesday. If this is the case, does that mean my contract is not yet legally binding and therefore if I give the 2 months notice before Wednesday, will the landlord not be able to claim the remaining period of remtal from me?
