I am a foreigner.
In 2013 l completed the purchase of a new res property in Melaka to be our retirement home. It is yet to be fully lived in but we visit at least once per year to maintain the property and have a local comany maintain the garden. (We also have MM2H.)
After all was completed on the purchase in 2013 l was told that as a foreigner there was a an extra 5% of purchase value tax to pay. However thIs tax was under appeal by the Developer so the funds were placed in escro.
In 2016 the appeal was upheld and the 5% returned.
I have since then been waiting to receive the registration deed.
Now in July 2020 l am advised this document is ready but the Authorities say l must now pay the 5% foreign person tax plus MYR15,000 (5 years at 3,000 to renew registrstion year by year 2013-2018) for a document l have never had.
Is any of this correct?
Is there such a 5% foreigners purchase tax (l cannot find any foreign property purchasers who have heard of or paid it)?
Can it be successfully appealed after three years only to be arbitrarily reinstated after seven years (2013/2016/2020)?
