I facing problem with property's owner in the deal as below :-
1- I had make a booking of 1% of purchase consideration to property's buyer without discuss in details.
2- I try look for bank loan and realized my payslip in error. It's take time to clarify with employer and submit to bank for loan application.Beside, i assigned to outstation for few weeks for job.
3- Property's owner continue advertise the property thru internet after 2 week time my pay booking fee.
4- realized that banker need property's document for land search etc. Banker try to get document from property's owner unfortunately property's owner only refer to lawyer not banker or me. In such incident, i try contact potential lawyer to obtain document from property's owner. It really time consuming to beg here and there. Further more, the property's owner warning me that he will charge me interest if i can't get loan within 3 mths period [we had not discuss these rule]
5- The loan was reject and i need re-submit document as per bank required.
6- Property's owner start ask to increase deposit to 10% and giving 2 weeks time to sign SnP. At same day, property's owner continue advertise thru internet.

My loan need 2 more days to release the result. Please enlighten me for query as below :-
a) Can property's owner forfeit the booking fee ?
b) Can property's owner charge me interest ? He starting to set the timeline 3 mth then turn to charge within 3 mth, for me, mutual agreement does not exist. He holding my booking fee and continue open to public and charge me interest.
c) I had seek for potential lawyer's advise that interest charge shld commence after SnP. Isn't it ?
d) I had record all the conversation in writing, does it helpful to me ?
