I live in a gated and guarded non stratified development and during the sales of this development all purchasers were obliged to sign the DMC and SPA concurrently.
However as time went by, the sub buyers did not sign the DMC as the developer handed over the management of the development to the RA.
We now have a problem that a few owners have decided not to pay for the service charges as they claim that they have not signed the DMC although they initially paid for several years upon moving in accepting the conditions stipulated.
How can we take action against the recalcitrants who have not signed the DMC during sub sales?
