In a 4 storey walk-up apartment block, there is a common stairway leading to the entrance of each individual unit of the upper 3 floors (each floor having only a single unit ) from the ground level. Each unit on the top floor has a spiral staircase at the back of the unit which leads down to a common walkway for all the top floor units & all the units on the floor immediately below the top floor units. This walkway is commonly used as the back entrance (and emergency escape) for these units.
Is the back stairway at each of the top floor units considered as common area, since the front staircase is considered as such?
