I've paid deposit for a property in June after the government announced HOC 2020. On the date of enquiry, we mentioned about the stamp duty exemption and 10‰ discount. The sales advisor listed all possible fees to be paid, including stamp duty, the only variable is the stamp duty because they need to wait for official gazette to be released at the time we sign SPA. And today 3st July, we went to sign the SPA, different story from them. The lawyer said we are not entitled to the exemption, we need to pay for it. I asked them why, they said official gazette not released yet . They said I can sign the SPA fist and wait til end of July for the official gazette. After we signed it, they said even the official gazette released , their properties does not qualify too. And I immediately checked the REHDA website, the developer name is not on the list, also the 10‰ rebate they given is not reflected in the SPA. Can I cancel the SPA once we've signed it? And does it consider deceiving that they didn't disclose any information on this when we laid deposit that day? Coz on that day they said exemption is possible depends on when the official gazette released but they already know they are not member of REHDA.
