JMB has no power to fix different rates of maintenance -On 14 October 2019, the Court of Appeal in Muhamad Nazri Muhamad v JMB Menara Rajawali and Denflow Sdn Bhd [2019] 10 CLJ 547...

By referring to this case, my condo JMB passed a resolution at AGM stated the commercial unit maintenance rate will change and follow the residential unit rate effective from 1/1/22. I would like to know whether the JMB should revise the rate from 14/10/19 onward instead of 1/1/22, since the above judgement obtain 14/10/19. The commercial unit owner got the right to appeal? Appeal revise rate from 14/10/19 or from the date from purchase the unit? Thanks.
