Normally there is clause stated in Letter offer to purchase which said : "In default of signing the SPA within 15 working days, by vendor(s), provided that there is no undue delay on the part of the Purchaser or purchaser's solicitor, then the vendor shall refund the earnest deposit sum together with a compensation sum of equivalent amount, which shall be shared equally between the Purchase(s) and estate agent failing which the Purchaser(s) shall be entitle to seek for specific performance at the cost and expense of the vendor". My question is:- if the vendor withdraw from this deal after signed Letter offer to Purchase, can I have 100% right claim compensation from vendor? Can I win this case if I sue him at court?
