Recently I have purchased a second hand house and signed off the SPA & loan docs. Got to know this shocking news from both side lawyers that this second hand house real owner has deceased many years ago and her husband still in the process of transferring name. Me and my brother were so shock and angry on the agent doesn't honest with us when we were reviewed the house. I immediately whatsapp the agent and requested her to chase the owner to quicken up the process of transferring name. According to the agent, the owner is in the final process in getting the order of sales and CTC from high court. Due to MCO implemented few times and pandemic period, me and my family have been waiting almost half a year for owner's side in getting the documents. We couldn't wait anymore so we ended up contact our SPA lawyer and agent for the progress. Sadly they gave us answer is still in progress. And another issue which make me and my family angry was the owner still renting the house to a family without us knowing. When we questioned the agent, the agent answered us the owner has the right to do so. It is unfair to me and my family. So now I am in difficult situation and have no idea what to do next because this is my first time purchase house and have no experiences at all. I have seek advises from many friends and they told me I was got cheated and need immediately file a police report. Due to I do not want to make this matter into a big matter, I decided to give grace period to the agent in chasing the owner in getting the docs within a month.
My questions to you all:
1) Did owner has the right to rent the house to others even though the SPA & CTC haven't proceed and the house still under his name? And is it true that owner need to get order of sales and CTC from the high court?
2) What if I managed to get house key at the end, and the house isn't in condition that what I have reviewed before. The SPA lawyer was introduced by the agent and any terms and conditions the
