The apartment unit below mine has complained of water marks on the slab soffit and Form 28 was served. There are no sign of wetness on my timber floor and at my kitchen cabinet above the wet spots at the slab soffit of the unit below. Based on the advice of all contractors and architects I consulted, fixing of the leakage should be approached from the bottom i.e. the slab soffit of the unit below, since no sign of leakage can be detected from my unit. Exact spot of leakage also cannot be determined and it is suspected to be a concealed pipe within the slab closer to the bottom or at the middle of the slab.

The owner of the unit below has, however, denied access for fixing of the leak via the wet spots at the unit's slab soffit, while expecting the leakage to be fixed nonetheless. What are my rights and recourse as the owner above this unit with wet spots, who is responsible to fix the leakage but is not permitted to access the unit below?
