Third party claim/suing JMC/MC in regards to land border.
We are in the process of stratified, yet to officially form council. Recently we received a court summon that we are being sue by a neighbouring land owner claiming that a small part of our condo fences wall was built upon their land.
Question, how can this be a legit claim, ain't of and plan approved by council before development commence?
Why suing residents and not developer?
Do they even have a valid case?
According to developer, there might be landslide retaining wall "nail" that was crossing the border.
Can they even sue the residents and not the developer?
Aren't we as home buyer protected by such clause during as stated in our s & p agreement.
