What if the seller refuses to bear the direct transfer administration fee imposed by the developer?
- The SPA has been signed by both parties.
- The down payment of 10% has also been paid to the seller.
- The loan agreement has also been signed.
The consent from the developer is required because the title has not been issued. However, the developer has requested for 1% of the Original Price or the Sub Sale Price whichever is higher ("Direct Transfer Administration Fee"). The developer clarified that this 1% should be paid by the seller, but the seller has refused to pay the fee. I understand that the developer is actually not allowed to impose any additional transfer fee other than the RM50 processing fee for each request.
