Why cant the management of a condo throttle down the water to 20% of the owner on grounds that his unit is causing a leak to the below unit.?

There is a leak from the unit upstairs to my unit below.
The management has inspected found the cause and Issued form 28.
The upstairs owner still refuse to repair.
Everyday the last 3 months i have to bear with the leak and stench which is at my kitchen .I cant even cook.
The management says i have to bear with it until the tribunal decides.
This not fair to me??
I am the one suffering the last 3 months.
the law says you cannot cut or stop any owner water supply but it doesnt mention you cannot reduce the supply so that the upstairs owner will have no choice but to repair to get back full water supply.
This can be done right?
