1. Is it a standard practice in Malaysia that the seller pays the agent fee within 14 days upon signing the S&P Agreement? Is it possible to pay the agent until whole process is completed e.g. after 3 months? (Is it negotiable of when to pay the agent?)

2. If the buyer fails to sign the S & P, will the deposit go to the seller?

dear sir, yes it is a standard practice to pay the agency fees upon signing the S&P. the deposit should be kept in the agency's client until the S&P is signed. in the event if the case is aborted, depending on the reason, the deposit will be forfeited or refunded to the purchaser. deposit do not go to the seller. the standard practice by the BOARD... seller pay agents commission.... which also will be the earnest deposit from the buyer.... either 2% - 3% to be collected upon booking from buyer.... this amount must be kept by real estate agent firm as stakeholder.... seller have no right to keep this money simply because the house is not completely transfer yet.... seller have no right (to avoid such cases like house cannot be transfered but seller use money already)...... if buyer fail to proceed due to any circumstances then the earnest deposit to be shared with seller and agent Read More

In Huttons, we practise this way. You can go through Hutton's format. Example:- House sold at rm1.1 Buyer will pay:- 1. 3% earnest deposit to Hutton's OneWorld 2. 7%. After 14 working days, buyer will pay to seller during S&P at lawyer's office 3. 90 % after 3+1 months .
