Dear Guru, my mother sold her house to a muslim guy in November 2014. The muslim guy were recommend by a property agent. When my mother signed the letter of confirmation of sale there was a special condition stated "subject to loan approval". We have giving him (the buyer) more than six months for him to obtain a housing loan. On 25/06/2015, my mother did wrote a letter to the buyer to action within 14 days failing which the contact will be terminated. His solicitor did act and prepare a draft Sale and Purchase Agreement. On 1st we receive the draft SPA and immediately reply and required the buyer solicitor to adjust/amend the necessary on the draft SPA. Until today the buyer solicitor did not get back to us on the fair Sale and Purchase Agreement. So, I need your advice how to go about when the solicitors are silent. Whether my mother still can call off the deal as per our letter dd 25/06/2015.

did the letter mention u need to sign spa in 14 working days? you can just call the agent tell the agent deal call off and you want to forfeit the deposit. you will share 50;50 with the agency. agent should not claim tat amount because spa is not sign. for sales it is always good to use own lawer instead of buyer's lawyer cz the lawyer can only act for one party. good luck if u need a lawyer i introduce my panel lawyer ask them giv u discount. now is tell the agent the deal is off n u want forfeit the money think the buyer will afraid Read More
