Hello Experts,
I booked a property on 28th Aug, all terms and condition were standard to get Sales and Purchase Agreement in 21 working days, with special condition that agent hold 3% and refund if there is no loan approved in 21 days.
Within 21 days no loan was approved, agent asked me to apply to few more banks and he promised he will get the extension. Based on his commitment I applied in other banks too.
But other banks rejected too.
Now I am asking agent for refund. He is saying company cannot refund until owner give the consent signature.
Owner is saying because I exceed the 21 days limit he want to take the deposit money.
This is one big agency of Malaysia. Now after three loan rejection when I am asking for refund they are telling owner want to forfeited as the time limit breached.
I am feeling cheated as agent always promised I will be getting my refund 100% sure and the condition is there of 21 days and three rejection letter. I need advice to get my money back. I have proof of Whatsapp chat, proof of rejection letter and special condition which says 21 days if loan is not approved agent will refund the money.
What is my fault in the whole scenario except trusting the agency?
Can agency keep on holding money ?
Why agency need consent of owner, why I need to wait for that?
Any help is appreciated
