Hi, appreciate for the professional advice. Thanks.

I have a unit of apartment with 3 owners include myself. I have moved out from the property while the other 2 owners are still staying and occupying.
The expenses like UTILITIES (gas, water, electricity, Indah Water...), MONTHLY CONDO MAINTENANCE, and HOUSE UPKEEP are relevant to be shared and paid by the owner who is not occupying the house? And how about the BILL CUKAI TAKSIRAN & CUKAI PETAK?

And also, I can collect a portion of rental from them as they are occupying the whole apartment?

Hi, from a practical property management persperctive:

- Utilities (water, electricity, gas, indah water) are usage-based and are usually paid by the owners who are occupying the unit.

- Monthly condo maintenance & sinking fund are ownership related and typically shared among all owners regardless of occupancy.

- House upkeep due to daily use is normally borne by the occupying owners.

- Cukai taksiran & cukai tanah are statutory owner obligations and are usually shared according to ownership share.

Lastly, if other co-owners are occupying the entire exclusively, it is reasonable to discuss an occupation rental with the non occupying owner, ideally agreed and documented in writing.

Hi Simone, while it is fine to collect proportional amount of rental from the occupying owners in the unit, you are legally liable for responsibilities of the activities in the unit including illegal bitcoin mining which could land you in jail.
