Hi good morning everyone,

I want to ask, if I have a tenant who refused to uproot himself from my property, despite being given ample time to remove himself as per the tenancy agreement, can I go for "small claims procedure" instead of the costly lawyering up?

The backlogged rent is below RM5000, and we already went through a 1 month time for him to remove himself from the property, which he failed.

Can we use this as a strategy to remove the tenant? Thank you very much

If by law, the only way is to apply evict order ( one of the court order) to force your tenant move out from the said premises, but subject to the term and condition written in the Tenancy Agreement. otherwise, you may contact your REN to discuss any alternately way and may effective by negotiation with the tenant.
