I have an American friend who is there right now to close his late father's sale of the property. He was told to pay the back taxes and lawyer's fees before he gets the proceeds of the sale. Can't it just be deducted from the sale instead of him coming up for the extra cash?

Don't think they allowed the thing to happen. But there is always a room for discussion, see if the property will be sold easily as they will now allow such things happen especially the tax department. Lawyer side still can proceed but not likely the tax side. Read More
