I have booked a commercial property unit on 16th june with a property agent and paid rm7600 2% earnest deposit and rm3400 1% agent fees to the agents agency company account. So i was waiting for a week or more for the owner to sign the booking form but owner suddenly didn’t sign then i get info from agent that they added some new extra clause into the booking form and want me to sign and amend it.
In the new clause the owner stated the earnest booking of rm7600 2% should be paid to the owner lawyer. So I already paid to property agency account and the agent say after i accept owner new terms and conditions the agent will take out the rm7600 deposit from starcity and give to owner lawyer.
My question is how the agent can take out the money? As I know can take out as refund subjected to my loan or owner dont want to sell. Is this normal? Is this safe? Please reply thanks.
