I have sold a condo and last week just signed the SPA. After much of debate with the purchaser's solicitor to amend the SPA for sale with legal possession. The lawyer 1st draft SPA was does not reflect the same. Then the purchaser is not available to sign the SPA after 21 days from the booking form date. The signing of the SPA was delayed for almost 1 month after heated arguement with the agent and the solicitor. After the signing I was informed that neither the lawyer nor the purchaser was informed that the purchase of the property was subject to legal possession. Despite my repeated reminder to the agent. Although the agent has "assure" me that the purchaser was notify of the same during the viewing and before signing of the booking form.
Could I file a complaint for misrepresentation by the agent? Can claim from the agent for the delays by the purchaser?

Hello,
If the public wants to file a complain against any agents or negotiators, they may first refer to the company agency principal or bosses. If that fails to garner any positive response then the public may file a complain against the agent/negotiator or agency to the Board governing our professional practice at http://search.lppeh.gov.my/
The agency's principal or bosses will be required to reply to the complain failing which they will be hauled up for an inquiry.
Hope this helps.
