Landed property purchased in year 2004, strata title only approved in 2018. Is developer liable for the delay? Currently, still servicing bank loan interest after 12 years. What can house-owner claim from develop for the delay? Is developer liable to absorb the legal fees for transfer of title to individual house owner.

There is usually no provision in the SPA for compensation by the developer in regards to the delay in obtaining the individual title. Sometimes the delay is not caused by the developer but the state land office. SPA only provide for late delivery of completion of property. All buyers are responsible to pay the stamp duty to perfect the transfer of the individual title to the buyer's name. Read More
