My dad owned a commercial property in Kuala Lumpur. The commercial property tiles had two names. My dad oldest brother and himself. My dad brother died in this year March. He was acute admission and passed away in hospital. We both fights this commercial whether want to sell or keep it. After the fights, both agreed to keep and rent it out. The money will be in half. My dad brother son will collect the rent money.
This year September, My dad flew to malaysia. He went to his brother house to collect his half rent but they were refused him to enter. After of this happened, he called his tenant to write two cheques. My cousin was phoned my dad, you can't do that as you have no right to do it. Family issues was happened a week.
My dad finally agreed to sell his commercial property. He went to see lawyer but he didn't have the commercial property tiles. The property title was kept by his brother. His brother was passing away and don't know where his put the documents to.
My dad went malaysia government department to obtain his commercial property title. After all this, he found out his commercial property title has had changed to his brother. The property titles name changed in March 2017.
He went to see the laywer, the lawyer gave his 3 possibility, 1- Your brother use your signature to sign the papers.
2- You signed the document by accidentally
3- The properties was originally under his brother.
The 2 & 3 was not valid. My dad confirmed he didn't sign any paperworks except cheque book.
My queries as below:
1- If you want to change the property name tile - Do you need the owner on this commercial property to attend for any paperwork and signature?
2 - The titles was changed in March 2017. My dad wasn't in Malaysia. How could it happens?
Do you have any lawyers that can give me?
