Both the purchase and the vendor of a property has signed booking fee.
However, both parties could not agree on the terms and conditions on illegal renovated works on the property. It appears that the negotiation has come to a dead end.
The purchaser has not instructed to lawyer to draft the SPA pending an agreement of the terms and conditions of the transactions.
Question:
1. What will happen if both parties fail to agree on the terms and conditions for the property transaction when it comes to the deadline to enter into a SPA stated in the booking form?
2. The purchaser has appointed a lawyer but the lawyer has not commenced on the drafting of SPA, pending an agreement on the illegally renovated works. The vendor is not appointing his own lawyer but will be using the purchaser's lawyer to complete the transaction. Will the purchaser be able to get back full refund of booking fee if the deal fails?
