BUYER BEWARE! A foreigner property purchase was rejected by Johor land office. No news of refund thereafter by advocates & solicitors Fadzilah, Ong Chee Siong on my 10% deposit. Already 1 month, how to get my deposit back when purchase is rejected.

Dear Mr. Pang, Isn't there a lawwyer acting for you when you buy the property? If the purchase is conditional upon approval by the land office and stated in the SPA then the deposit should not be forfeited. The other clause will be a time frame for the foreign buyer to get the approval failing which the SPA will be aborted. It really depends on the terms and conditions stated in the SPA. Read More

    Thanks Mr David Wong, but you got it wrong. I was represented by Fadzilah, Ong Chee Siong & associates, introduce by the seller's agent from Top Hill Reality in Johor. 1% was given to the agent to be forward to the seller. Balance 9% was paid to F,OCS&A after signing the SPA. Hence, the state consent application had been rejected, I have not receive any refund from F,OCS&A as stated in the SPA. Another Question is, a sales & marketing manager, Gary Tan, working for F,OCS&A, handling this transaction, briefly email me that the application had been rejected. Without any formal letter or letters of rejection from the authority. Multipal emails sent & phone calls have not been replied. Is there any action I can get to get my 10% back, consult another lawyer, can I trust???
