Can I cancel the tenancy agreement after signed? We still have a month times before move in. The reason is because the property agent cheated on us on the car parks location. We viewed the unit two times, the 3rd times we go back to the unit for signing agreement and after signed and deposit paid, only he told us car parks are not located at LG1, but level 3 which has to go through 4 level from LG1, LG2, LG3, L1, L2 to get to L3

If you have signed the Tenancy Agreement and the Landlord has signed and stamped it then you will need to abiode by the terms stated therein. If you terminate the contract (unless there is a clause priviso to do so) you may be still be liable for paying for the whole duration of the tenancy contracted or your full deposits will be forfeited. The misconduct or misrepresentation of the agent or negotiator is a separate matter altogether. You may want to talk to the principal license holder of the real estate agency on your complain of misrepresentation by their agent or negotiator and hopefully the agency can help you out without any penalty or loss incurred as the agency has a fiduciary duty to the client and the customer. Otherwise, you may make an official complain to the professional board www.lppeh.gov.my that governs our profession and the agency will be hauled up for inquiry. The decision of the board to fine or suspend the agency will depends on the offense and whether it is repeated by the agency.
