If only it is mutually agreed by the Seller. However, please bear in mind that the 3% has to be retained by the lawyer and paid to Dept of Inland Revenue for clearance of Real property gains Tax (RPGT) upfront so it is very unlikely the Vendor shall agree because he will not be retaining and deposit as security on the purchase.
