Dear All Guru,

I have sold my house and signed S&P, however I discovered that my agent cheated me. She persuaded me to sell the house which below market value of ~30% (RM150K) and sell it to the buyer higher by market value ~10% also with the commission paid ~10k. Dear all gurus, please advise me what can I do against the agent? Can I sue her for no duty of care as an property agent?

Dear Ann. Your comments are serious as we are a regulated professional practice. I am a licensed practitioner and such incidences could tarnish our profession. Anyone can consult a lawyer to sue somebody if they have enough factual evidence or witnesses to the case and I am not a lawyer to advise you on this what more your facts are not verified. However, I do advise you bring up this matter to the attentione of the licensed holder of the agency firm. Some licensed practitioners do not know what their non-licensed negotiators are doing. The Malaysian Estate Agency Standards; Standard 5 on Code of Conduct & Ethics. If you fail to address this issue amicably then you may also file a complaint to the Board of Valuers, Appraisers & Estate Agents, Malaysia (www.lppeh.gov.my).
