Does seller and buyer need to pay agent commission upon a successful transaction? If so, how much is this fee? If a buyer contacts the seller's agent directly, eg via PropertyGuru, is the buyer still liable to pay agent commission if the deal is done? Wouldn't there be a conflict of interest?

Hello Mr. Alex Bay,
Under our Board's guideline (www.lppeh.gov.my), a Seller or a Buyer can engage the services of an estate agent and pay the standard fee provided by the guidelines. Typically for a tenancy of up to 3 years, the client who engage the services of the estate agent pays up to 1.25 month's rental although it can be more for leases above 3 years.
If a buyer response to a listing by a Seller's agent advertised eg in Property Guru, the buyer need not pay the agent which is already engaged by the Seller as the fee is already contracted to be paid by the Seller. An agent is not allowed to collect fees from both seller and buyer as it will be a conflict of interest as to who does the agent represent unless it is openly accepted by all parties.
