There may be a confusion whether the 1% is an earnest deposit to offer to purchase the house and form part of the purchase price as oppose to being a commission upfront. The wordings stated in the Letter of Offer should explain the intention of this 1% clearly. If it is really an agent's commission then the answer is no because fees are payable only after an unconditional SPA is signed by both Vendor and Purchaser. Read More
