Hi, I am going to purchase a second hand house in Melaka. We discuss this directly with the owner (saw his wedding picture in the house) and had reach mutual agreement on the price.

However, he claim that somehow the title is not being transferred to his name by the developer and if we going to purchase, he can directly ask the title owner directly transferred from the developer to us.

In this case, who should we pay the money to? The developer or the so called "owner"? We afraid there something fishy behind this. Can anyone advise on this matter?

It is unusual for a title deed for houses not to be transferred to the rightful owner, if the owner has paid the developer the full purchase price. You may conduct a title search and check with the developer yourself or through you lawyer to verify who is the actual owner of the said house before you pay any earnest deposit whatsoever to the person who claim to be the owner. Alternatively, he may show you his stamped copy of the Sale & Purchase Agreement with the developer to proof his ownership but even Sale & Purchase Agreement can be aborted due to non compliance of payments etc by the purchaser.
