i had been told by the agent, i need to pay the 1% commission fee to her as this is the rules set in Malaysia. She get me to sign a agreement which i agree to pay her the fee upon SPA signing. i found out from others that buyer did not required to pay the fee as the 2%-3% commission fee should be pay from seller to agent. The agent had misleading me by providing the wrong info. i'm queries should i pay her since i had signed the agreement in this scenario?

Based on the law of contract you need to pay her provided the contract spells out when the fee is payable. It is very hard to proof that the agent had mislead you although you can file a complaint against the agency that the agent represents with the Board of Valuers, Appraisers & Estate Agents, Malaysia (www.lppeh.gov.my)
Under the fees guidelines, a seller or a buyer can engage their own agents to negotiate the deal and pay the fee of up to 3% of the transacted price. The agent is discouraged from accepting fees from both the seller and the buyer without the prior consent from either party to avoid conflict of representation.
