The tenant defaulted the tenancy agreement after 2 months. However i already paid the 2 years tenancy commission to the agent . i would like to know :
1) is the agent obliged to look for a replacement tenant ?
2) If not, any recourse for the landlord. Can landlord request the agent to returned part of the commission?
3) What is the period that can give to the agent to find a replacement for the tenant ? What if the agent not putting in the effort to find the replacement ? Any recourse for the landlord?

The agent's role is to find and secure a Tenant and get the Tenancy Agreement signed with the Landlord at mutually agreeable terms and conditions including payments of deposits and advance rental. The agent, although is expected to screen the background of the Tenant does not guarantee that the Tenant will not breach or break the Tenancy Agreement contract. there is legal recourse for the Landlord to take legal action against the Tenant to recover the rentals or obtain compensation for the breach of contract eg. forfeit the deposits etc. The agent is paid for the service to secure a Tenant who commits to the Tenancy Agreement and the fee of one (1) month's rental is for the services already rendered. 1.
