Whoever engages the agents services will pay the agent's fee provided it is agreed between the client and agent upfront. Most of the time it's the Landlord that engages the services of agents to help them rent out the house/condo by placing advertisements, banners etc. Hence the fee is paid by the Landlord. However, there are certain instances the Tenant hires and pays for the services of an agent to find them a particular property to rent.     Hi, i am looking for a unit to rent in Penang and contacted listing agent from their online advertisement. Strangely, the agent is quoting me agent fee and agreement fee. Is this allowed? That is not the case where i rent from others state i.e. selangor, KL and Melaka.

    The rule is that the agency is not allowed to collect two sets of fees from both the Landlord and the Tenant for the same rental transaction as there will be a conflict of interest as who the agency represents. (check out www.lppeh.gov.my). It looks like many agencies in Penang are not practicing accordingly. It looks like some (if not most) of the negotiators (sales person) of the agencies in Penang with listings for rent are compelling tenants who make enquiry to agree to pay them a fee for the listing that they advertised. However, the irony is that it is acceptable if the Tenant engages another real estate agency to represent them to co-agent with the listing negotiator from another agency. You may lodged a complaint to our board of governance (BOVAEP) for best practices and ethics (www.lppeh.gov.my) with sufficient proof in writing etc.

    Is this still true? I am searching for unit in Penang using online listing (not hiring an agent), however the agent said both me and owner need to pay the fee. I have two agents that told me so.
