The obligations of the parties is provided under the Tenancy Agreement executed between the landlord and the tenant. Basically, the tenant’s children do not have the obligation to pay the outstanding utility bills because the Tenancy Agreement is executed between the landlord and the late tenant who has passed away.

In estate matters, generally, the deceased person’s debt shall be paid from the deceased estate. In simple words meaning before the distribution of the deceased’s assets to his / her beneficiaries, any debts due and owing has to be deducted first.

Therefore, it is best to discuss with the executor (in cases of Will) or the administrator (in cases where there is no Will) for an amicable solution.
