Yes, you have correctly pointed out that the land laws and housing laws are different in Peninsular Malaysia and Sarawak.

The Strata Management Act 2013 (“SMA 2013”) for the purposes of ensuring laws and policy relating to the maintenance and management of buildings and common property is only applicable to Peninsular Malaysia and the Federal Territory of Labuan as stipulated in Section 1(2) of the SMA 2013.

If there is any dispute that arises in Sarawak then it should be brought before the Court in Sarawak whether it is the High Court, Sessions Court or Magistrates Court of Sarawak. The Federal Court is only for appellate matters.
