I truly appreciate if you could help to provide some insights of my situation below.
I am a first home buyer, and I have tried my very best to survey around on the procedures in buying a property for myself however, there are still a lot to learn and tried my very best to ensure things are in place during my purchase.
Long story short, I would like to utilise the first home buyer benefit (MOT exemption for property below RM500k) and I have finally got myself a subsale home. The property that I bought is a Service Apartment (which I am totally not aware that it is not MOT exempted at that point of time) and I have consulted the property agent if I could get MOT exemption for this unit, and I was told exemption is applicable as long as I am first home buyer. Hence, I proceeded to book the unit.
During the day I am about to sign the S&P agreement and I have met the S&P lawyer, I have double confirmed with the lawyer if the MOT can be exempted for the unit I bought and she assured me that it will be exempted as long as I do not own any property as per date. (The lawyer is aware that the unit I bought is a Service Apartment).
As months goes by, even after I have received the house key from the s&p lawyer, there wasn’t any updates from the s&p lawyer about the MOT charges until i receive a letter from the firm regarding the breakdown of the legal fees payment. I noticed I was charged with MOT fee and I immediately contacted the s&p lawyer. The lawyer claimed that she has did the appeal with LHDN but it was failed and hence, she proceeded to pay the MOT charges without even informing that I have got charged with MOT (This happens 2 months before i receive the letter of the breakdown charges).
I have been following up with the S&P lawyer what are the ways I can get this exemption or if there is other ways to reduce my overall payment since the S&P lawyer and the property agent have assured me that I would ge
