Petaling Jaya residents claims that a condominium development located on Bukit Gasing did not suit the natural vista.

Located at Kampung Kerinchi Dalam, on the Kuala Lumpur side of the hill, the project’s signboard says that the development will comprise 408 apartments units spread across two 27-storey blocks, and 18 units of two-and-a-half storey villa, reported The Star.

According to Petaling Jaya councillor Derek Fernandez, the project spoils the natural vista, a requirement based on Total Planning and Development Guidelines established by the Town and Country Planning Peninsular Malaysia.

“It is a legal requirement by the Town and Country Planning Department that the beauty of the natural environment should be the main factor in planning land use activities to minimise disturbance to the existing habitat,” he said.

“Buildings should not be higher than the natural skyline.”

Commenting on the issue, Kuala Lumpur mayor Datuk Ahmad Phesal Talib said the development was approved way back in 2008.

“We will not be able to do much since the approval was given in 2008, but we will check on the earthworks carried out.”

“If any development is done contrary to the given approval or if the developer does not follow the set requirements, I will issue stop-work order, which I have done in the past,” he said.

Meanwhile, a spokesman for the developer explained that the proposed project had followed the requirements under Federal Territory (Planning) Act 1982.

“These included the processes of Rule 5 under Planning (Development) Rules 1970 requiring us to notify and inform the parties of interest on the proposed development, which was held by DBKL in 2011.”

He also clarified that the proposed site is freehold and not part of the current Bukit Gasing forest reserve, as claimed by the residents.

“Claims by Petaling Jaya residents that our project has taken away the Bukit Gasing skyline is not true,” he added.
