Shop Owners Unhappy Over Long Wait

Some people who have bought shop units at Sungai Long in Kajang complained that they were not able to use their properties despite their completion a year ago due to the absence of the Certificate of Compliance and Completion (CCC), reported The Star.

One of the affected owners, 41-year-old Alvina Kam, said she purchased a shop-lot in the area in 2013. But when the unit was finished and handed over in June 2016, the developer failed to provide this vital document.

“We called the developer but was told that the CCC was not included in the sales and purchase agreement (SPA).”

“I bought the shoplot as an investment but without the CCC, I cannot do anything, including sell, rent or renovate the shop,” she noted, adding that she had to fork out RM10,000 a month in installments for the unit.

Thankfully, she finally obtained the CCC with the help of Balakong Assemblyman Eddie Ng, who advised buyers to ensure that this important document is included in the handover.

He explained that under the Housing Development (Control and Licensing) Act of 1966 and Regulation 11 of the Housing Development (Control and Licensing) Regulations of 1989, the CCC must be included by the developer when handing over the property and this must be stated in the signed agreement.

But this only applies to housing projects, meaning the developer can exclude this document for industrial and commercial developments without suffering any legal consequences.

Thus, he is calling the Housing Ministry to plug this loophole. For the meantime, he advises buyers of such units to make sure that the date of getting the CCC is included in the SPA.

Without the CCC, buyers cannot conduct commercial or industrial activities in their completed properties even if the utilities like water and electricity are already working. They cannot even apply for licences or perform renovations.

“In the end, the buyer has to bear the installment loans without any income,” Ng added.

Is this a case of Developer taking advantage of buyers with possible collusion of Architet and/or Lawyer as buyers normally the low income earners do not understand the financial implications of T&C in S&P AGREEMENTS as they have trust (though misplaced) in the honesty and ethics of their professionals. I was a victim after my late father bought in 1967 two units @ RM11K each and were ready in 1971 and delivered but without titles. The Developer collected quit rent from buyers for 30 yrs but did not pay to Land office on the master title for 30 years. Later he collected the individual titles and offerred to buyers for additional payment of RM9.5K each for 100+ houses. The payment included about RM5K each for penalties imposed for late payments. My lawyer advised me to pay and treat the RM19.0K as cost of lesson for not understanding the T&C. Is this not an abuse by Developers and Professionals via the loophole in the laws?
